Military Divorce & Child Custody / Visitation Rights in San Diego

Basically, a military divorce proceeds like a civilian divorce, with the exception of child custody and visitation problems which are more complex since the parents normally are not stationed at the same duty station; child visitation is especially difficult.

On the child support and spousal support (alimony) the LES provides the basic allowance for support and so interpreting the pay grades is important. Finally, dividing the military longevity pension is based on a Federal plan that must be followed. The military pension itself is divided by DFAS after a Domestic Relations Order is obtained in California family law courts.
